General Terms & Conditions
1. Scope
These General Terms and Conditions apply to all business relationships between Brunner Webhosting (hereinafter 'Provider') and the customer. Deviating terms and conditions of the customer are not recognised unless the Provider expressly agrees to their validity in writing.
2. Prices and Payment
All prices are exclusive of VAT. Invoicing is carried out annually in advance. Payment is due within 14 days of receipt of invoice. In case of late payment, default interest at the statutory rate will be charged.
3. Scope of Services
The Provider makes storage space on a server and internet access available to the customer. The exact scope of services is defined by the respective service description of the chosen hosting package. The Provider strives for a server availability of 99.9% as an annual average.
4. Data Protection
The Provider only collects and processes personal data of the customer insofar as this is necessary for the performance of the contractual relationship. Further details are governed by our privacy policy.
5. Customer Obligations
The customer undertakes not to use the provided storage space for unlawful content. The customer is responsible for backing up their own data. The customer must keep their access credentials confidential and protect them from third-party access.
6. Liability
The Provider is only liable for damages resulting from intentional or grossly negligent conduct. Liability for indirect damages, in particular lost profits, is excluded to the extent permitted by law.
7. Contract Duration and Termination
The contract is concluded for an indefinite period. It can be terminated by either party with 14 days' notice at the end of a contract year. The right to terminate without notice for good cause remains unaffected.
8. Reseller Provisions
Resellers are responsible for compliance with these terms by their end customers. The reseller indemnifies the Provider against all third-party claims resulting from a violation of these provisions by end customers.
9. Final Provisions
Austrian law applies. The place of jurisdiction is Steyr. Should any provision of these terms be invalid, this shall not affect the validity of the remaining provisions.
